Suit –Kakamega County Senator Boni Khalwale has, today, filed a sh 1.3b suit against Kakamega businessman Cleophas ‘Toto’ Shimanyula.
Making this confirmation today Monday February 19 afternoon, the politician flanked by his lawyers and supporters, stated that he had finally made the decision to seek the compensation from the businessman.
“Our lawyers have finally sued that misguided and scandalsous man from Kakamega,” Khalwale remarked in a statement seen by Kenyawide.com.
And commenting on the matter, his lawyers led by Danstan Omari, announced that they had successfully filed the matter at the High Court after it emerged that Magistrates Court has a weaker compensation ceiling of sh 20 million only.
“The jurisdiction of a magistrates’ courts aims at only sh 20 million and that’s why we had to file this case in the High Court,” Lawyer Omari explained.
To defend this decision, he said the accused, Toto Shimanyula, had used obscene language against his client; something that should not happen in a civilized environment.
“Words spoken were defamatory and which should not be used in a caviled democracy. They are obscene, demeaning and aimed at affecting the career of Khalwale as a politician, medical doctor and family man,” Omari further argued.
The Lawyer, while breaking down the demanded amount, clarified that each family member including the four wives will be seeking at least sh 200 million each from the accused.
He, therefore, announced that, in the suit, the claimant will be demanding a whopping total figure of sh 1.3 billion.
Khalwale has been embroiled in a political wrangle with businessman-cum-contractor Toto who accused him of having murdered his caretaker, the late Kizito Moi Amukune who is now laid to rest.
Toto claimed to have gathered evidence against Khalwale over the death of the farm worker who Khalwale had reported that was gored to death by his bull, Inasio.
